THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION NO.4822 OF 2015 ORDER:
The petitioner herein seeks direction on inaction of the respondents in paying compensation as per G.O.Ms.No.50 General Administration (SC.A) Department dated 21.02.2014 as arbitrary and illegal and seeks a further relief that the second respondent be directed to consider his claim based upon his request made to the Collector under his latest representation-Ex.P1 dated 22.12.2014. Similar issue was already considered by me in Writ Petition No.37552 of 2014 dated 06.12.2014.
Heard the learned counsel for the petitioner and the learned Government Pleader for GAD.
In terms of the directions already issued in the Writ Petition referred to above, this Writ Petition is disposed of with the following direction.
"In the circumstances, the Writ Petition is disposed of directing the second respondent to take appropriate decision on the application filed by the petitioner, referred to above, by taking note of the fact that the petitioner is seeking exgratia, in lieu of employment in terms of G.O.Ms.No.50 dated 21.02.2014, and process the said application and if the petitioner is found eligible, the second respondent shall ask the petitioner to execute appropriate documents to be able to receive exgratia in terms of the scheme, referred to above. Since the incident has occurred almost in 1998, it is imperative th t appropriate decision is taken, as directed above, expeditiously, preferably before the end of March 2015."
There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
