O R D E R

Alleging that respondent No.2 - Station House Office / Sub Inspector of Police, Gajuwaka Police Station, Gajuwaka, Visakhaptnam, is frequently calling the petitioner to the police station at the instance of unofficial respondent No.3 and threatening him, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of the 2nd respondent. In the written instructions the allegations of the petitioner are denied. It is further stated as under: "It is pertinent to mention herein that in connection with a suicidal death of one Lokeswara Rao, who is the husband of the 3rd respondent herein, a case in Cr.No.347 of 2018 was registered on the file of the 2nd respondent police station under Section 174 Cr.P.C. and the same is pending investigation.

In the said complaint, the name of the institute of the writ petitioner herein was mentioned once. Basing on the same, by assuming that he may be called to the police station for the purpose of enquiry, with a view to restrain the police, he filed the present writ petition by raising certain concocted allegations."

Recording the above statement, writ petition is disposed of. It is made clear that the 2nd respondent shall not interfere with the life and liberty of the petitioner. In case the presence of the petitioner is required for the purpose of investigation, the same shall be strictly in accordance with law. Miscellaneous petitions pending, if any, shall stand closed.
