THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9287 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 and 2 in Crime.No.88 of 2023 on the file of Danthalapally Police Station, Mahbubabad District, registered for the offences under Sections 452 and 307 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant who is the petitioner's brother's wife lodged a complaint stating that in the year, 2002 ancestral property was partitioned when her in laws were alive. These petitioners and wife of A-1 erected boundary stones in the plot which fell into the share of de-facto complainant. It is alleged that A-1 to A-3 attacked

the injured with an iron rod in the house with an intention to kill him.

Learned counsel appearing for the petitioners would submit that on account of family disputes, a false complaint is filed. These petitioners never attacked nor injured the de-facto complainant's husband.

Learned Additional Public Prosecutor on instructions would submit that the injured was discharged from the hospital and he received one grievous injury and a simple injury.

Keeping in view that there are family disputes resulting in the altercation and the petitioners' being aged around 60 years, they can be granted the relief of regular bail, subject to following conditions:

i) The petitioners/Accused Nos.1 and 2 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Thorrur, Mahbubabad District.

ii) The petitioners/Accused Nos.1 and 2 after release shall appear before the concerned Station House Officer as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
