THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7426 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A2 in Crime No.311 of 2022 on the file of Hanamkonda Police Station, Warangal District, registered for the offences punishable under Section 8(c) read with 20(b) of NDPS Act, and Section 21 and 22 of NDPS Amendment Act. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The allegation against this petitioner is that he was found in possession of 1.5 Kgs. of dry ganja and also 2 MDMA Pills weighting 0.040 grams by the Hanamkonda Police. 3.

Learned Counsel for the petitioner submits that the petitioner is a student and that he is falsely implicated. 4.

On the other hand learned Assistant Public Prosecutor on instructions would submit that there are no questionable antecedents as far as this petitioner is concerned.

Keeping in view the contraband seized is less than the commercial quantity, and that there are no questionable antecedents against this petitioner, this petitioner can be granted the relief of bail subject to the following conditions: i) The petitioner/A2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of I District & Sessions Judge (For NDPS Cases) at Warangal. ii) The petitioner/A2, after release shall appear before the concerned Station House Officer every Monday between 10.30 A.M. to 1.00 P.M., for a period of three months or till filing of charge sheet whichever is earlier, for the purpose of investigation.

iii) The petitioner/A2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
