THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22883 OF 2016 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

2. The present Writ Petition is filed with the following prayer: "to issue a Writ, order or direction more fully one in the nature of Writ of Mandamus declaring the inaction of the respondents in concluding the investigation of the crime in FIR No.87/2015, dated 09.09.2015 of the Pedakurapadu Police Station, Pedakurapadu Village and Mandal, Guntur District, A.P., as biased, illegal and capricious and consequently direct the respondents 3 and 4 herein to finish the investigation in the aforesaid crime without further delay."

3. The grievance of the petitioner is in spite of registering a crime for the offences punishable under Sections 323, 420, 447, 506 read with 34 IPC and Section 3(1)(x) of the SC/ST (POA) Act, on 09.09.2015, basing the on the report lodged by the petitioner, the respondents-police are neither proceeding further with the investigation nor initiating any appropriate action against the accused.

4. Learned Government Pleader for Home submits that the investigation is going on and charge sheet will be filed at the earliest.

6. Having regard to the above, the Writ Petition is disposed of directing the respondents-police to proceed with the investigation

in Crime No.87 of 2015 of Pedakurapadu Police Station, Guntur District, in accordance with law, and to file charge sheet or final report, as the case may be, as early as possible preferably within a period of four (04) to five (05) months from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
