HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU AS.No. 2071 of 1998 ORDER:

This is an appeal filed against the decree and judgment dated 13.08.1997 passed in OP.No.235 of 1995 by the Subordinate Judge, Avanigadda.

When the matter came up for hearing, neither party is unable to furnish any information whether the matter is settled or not.

The counsel for the defendant-Bank states that they are unable to trace the records.

Learned counsel for the appellant is also unable to throw any light in the matter.

Hence, this Court is of the opinion that no purpose will be served by merely keeping the matter pending. In view of the fact that the arguments are not progressing, the appeal is dismissed. No costs. Consequently, miscellaneous petitions, if any, pending in this appeal shall stand closed.
