THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24704 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the acts, deeds and things of the 6th respondent are illegal, against to law and much against to the legal and fundamental rights guaranteed under the Constitution of India and consequently direct the 6th respondent not to interfere with the life, liberty and house property bearing H. No. 1-68 (old 4-4-56), Chandraiah Nagar, Quthbullapur Village & Mandal, Ranga Reddy District of the petitioner without following due process of law." Heard Sri Palivela Satyarajababu, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.
Today, when the matter is called, written instructions, dated 10-08-2015 furnished by the Sub-Inspector of Police, Jeedimetla Police Station, Cyberabad Commissionerate have been placed on record by the learned Government Pleader for Home and the said instructions read as under:
"It is respectfully submitted that as per the records, as of now, no complaint or case whatsoever was received or registered against the petitioner herein on the file of Jeedimetla Police Station, Cyberabad Commissionerate.
It is submitted that the allegation of the petitioner that it seems that the 7th respondent approached this respondent police station for getting her illegally dispossessed from her house property and it seems, for obvious reasons and considerations, this respondent sent police personnel to her house on 30.7.2015 for threatening her and in fact the police personnel threatened her to vacate and hand over her house property to the 7th respondent herein and along with the police people sent by this respondent, some other private persons
also came to her house on that date is absolutely false, baseless and hence denied.
It is pertinent to submit that at no point of time, this respondent sent any of the police personnel to the house of the petitioner herein nor threatened her asked her to vacate the subject house property in question and hand over the same to the 7th respondent herein.
It is pertinent to submit that the dispute of the petitioner as well as the respondent herein is purely civil in nature and hence this respondent police has nothing to do with it. Having personal grudge and settle her personal scores against the 7th respondent herein, the petitioner made baseless allegations against the respondent police which are far from truth.
This respondent enquiries revealed that, as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint in future, the petitioner rushed to this Hon'ble Court and filed the writ petition with false and frivolous allegations."
On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and close the writ petition.
In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 10-08-2015 furnished by the Sub-Inspector of Police, Jeedimetla Police Station, Cyberabad Commissionerate.
