This Transfer CMP is filed by the petitioner/wife to withdraw F.C.O.P.No.463 of 2015, filed for divorce by respondent/husband, from the file of Additional Family Court at Visakhapatnam and transfer the same to the Family Court, Secunderabad.

The case of the petitioner is that her marriage with respondent took place on 21-08-2013 as per Hindu rites. After the marriage, relations were strained between the petitioner and the respondent and the respondent started demanding additional dowry. Then the petitioner gave complaint to the police and the same was registered as Cr.No.89 of 2015, which is pending on the file of Women Police Station, Begumpet.

Thereafter, the respondent filed present FCOP.No.463 of 2015 for divorce on the file of Additional Family Court, Visakhapatnam, though the respondent is working at Hyderabad. It is stated that the petitioner has no male assistance except married sisters. As such, it is difficult for her to go to Visakhapatnam and the petitioner apprehends danger to her life from the respondents. As such, transfer CMP is filed.

Heard learned counsel for the petitioner and the learned counsel for the respondent.

The petitioner stated that the respondent is working at Hyderabad and the same is not controverted by filing any counter. It is also stated that already the criminal proceedings are pending at Hyderabad and when the respondent is working at Hyderabad, it is not inconvenient to him to attend Family Court at Hyderabad.

In view of the above facts and circumstances, I am of the opinion that it is just and necessary to transfer FCOP.No.463 of 2015 from the file of Additional Family Court, Visakhapatnam to the Family Court, Secunderabad.

Accordingly, the Transfer CMP is allowed. Miscellaneous petitions pending, if any, in the Tr.CMP. shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-12-2015 Nvl
