O R D E R
Alleging that 4th respondent - Station House Officer, M.R.Palli, Police Station, Tirupathi, Chittoor District, is interfering with the possession of the petitioners and threatening them to vacate the subject property, and is not providing police aid as per the directions of the court of I Additional Junior Civil Judge, Tirupati in I.A.No.1101 of 2015 in O.S.No.448 of 2015 dated 03.11.2015, I.A.No.586 of 2017 in O.S.No.768 of 2016 dated 4.9.2017 and I.A.No.950 of 2016 in O.S.No.650 of 2016 dated 17.4.2017, the present writ petition is filed, seeking for a direction not to interfere with their property and to provide police aid.
Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Home produced written instructions of Inspector of Police, M.R.Palli Police Station, Tirupathi, Urban District, denying the allegations of the petitioners and stating inter alia that if the petitioners obtain orders from the civil court, police are ready to give protection.
As per the writ averments and the material produced by the petitioners, it could be seen that in the interlocutory applications referred to above, the court of I Additional Junior Civil Civil Judge, considering that the petitioners have been in possession of the subject property, granted injunction and directed the 4th respondent, to provide police aid in I.A.No.1101/2015 in O.S.No.448 of 2015 dated 03.11.2015.
In view of the statement made in the written instructions and the directions of the civil court in the interlocutory applications in the suits filed by the petitioners, referred to above, writ petition is disposed of directing the 4th respondent to provide police aid as sought for by the petitioners.
