THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4244 OF 2016 ORDER:

The petitioners-A1 to A3 preferred the present Criminal Petition by invoking the provision under Section 482 of the Code of Criminal Procedure (in short 'Cr.P.C.') seeking to quash the proceedings in S.C.No.746 of 2015 on the file of the II Special Sessions Judge, Ranga Reddy District, L.B. Nagar.

Heard and perused the material available on record. The offences alleged against the petitioners are punishable under Sections 354, 354-D, 366 and 509 IPC. It is alleged that the 1st petitioner used to follow the de facto complainant and used to force her to marry him and on the date of incident, he took her in his car, along with his mother and brother, and tried to marry her forcibly and the de facto complainant escaped from their hands and thereafter, they went the house of the de facto complainant and abused them and threatened them with dire consequences. Admittedly, after duly investigating into the complaint lodged by the de facto complainant, the Police filed charge sheet against the petitioners and other accused.

A reading of the charge sheet also reveals some allegations against the petitioners, truth of which can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioners.

At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of the petitioners 2 and 3 only is dispensed with before the trial Court, except on the dates on which the learned trial Judge insists for their appearance. Further, the petitioners 2 and 3 shall be properly represented through their counsel before the trial Court.

Accordingly, the Criminal Petition is disposed of. Consequently,

the Miscellaneous Petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J March 29, 2016.
