HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.25929 of 2019 ORDER :

This writ petition is filed seeking Writ of Prohibition restraining the Agent to the Government and Collector for Agency Cases at Adilabad from entertaining Appeal No.F1/1805/2019 filed challenging the order dt.15.07.2019 in Case No.A4/CPC/845/2012 passed by the Additional Agent to Government and Project Officer, ITDA, Utnoor, and pass such further orders.

Heard Sri B. Vijaysen Reddy, learned counsel for the petitioner and the learned Government Pleader for Forests appearing for the respondents.

Learned Government Pleader for Forests has produced a copy of the order dt.19.11.2019 in Case No.F1/1805/2019 issued by the Agent to the Government and District Collector, Adilabad District, the relevant portion of which reads as follows:

"In view of the above citations and Government orders, the case cannot be taken up as an appeal. Hence without going into the merits of the case, it is hereby ordered that the Forest Department is at liberty either to approach the Addl. Agent to the Government & the Project Officer, ITDA, Utnoor, for review of the orders or approach the Hon'ble High Court of Telangana challenging the orders of the Addl.

Since the contention of the petitioner is upheld by the authority, nothing survives for adjudication in the writ petition.

Recording the said submission, this writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
