HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 1779 OF 2005 JUDGMENT: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the appellant and learned Government Pleader for Endowments for respondent Nos.2 to 4. None appears for the other respondents though served. This appeal is directed against the following order dated 10-06-2005 passed in WPMP No. 5871of 2004 in Writ Petition No. 4480 of 2004:

"Learned counsel for the fifth respondent is absent and there is no representation. The petitioner has made out prima facie case warranting action by the Revenue Divisional Officer having jurisdiction over the matter to initiate proceedings under Section 77 of the A.P Charitable and Hindu Religious Institutions and Endowments Act, 1987. Therefore, there shall be a direction.

The WPMP is accordingly disposed of."

This Court while admitting the appeal on 17-10-2005, stayed the aforementioned order dated 10-06-2005 keeping it open for the respondents to initiate action under Section 77 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, if they so desire. We do not deem it appropriate to keep this appeal pending since the order of stay is running against contesting respondents for last about 11 years. At no point of time, they made an

application for vacating the interim order passed by this Court. Writ petition is still pending. We request the learned single Judge to decide the writ petition, which is pending since 2004, expeditiously. With these observations, writ appeal is disposed of. Miscellaneous petitions, if any, also stand disposed of. No order as to costs.
