THE HON'BLE SRI JUSTICE A. ABHISHEK REDDY WRIT PETITION No.30309 of 2021 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for all the respondents. With their consent, the present Writ Petition is being disposed of at the admission stage.

Questioning the communication sent by the respondents on 28.10.2021 rejecting the application of the petitioner for deleting the subject lands situated at Malkidhanguda Village, Maheshwaram Mandal, Ranga Reddy District, from the list of prohibited properties, the petitioner filed the present Writ Petition.

A perusal of the impugned communication shows that the application made by the petitioner for removing the subject lands from the list of prohibited properties is rejected on the ground that there is a stay order passed by the Court. The learned counsel for the petitioner has stated that with respect to the subject lands, I.A.No.439 of 2019 in O.S.No.613 of 2019 filed by one P. Raghu Chandar Rao for grant of temporary injunction was dismissed by the trial Court vide order dated 13.11.2019. That against the said dismissal order dated 13.11.2019, the said P. Raghu Chandar Rao has filed

AAR, J W.P.No.30309 of 2021 CMA.No.1152 of 2019 before the Division Bench of this Court and later, withdrawn the same.

Having regard to the above, the present Writ Petition is allowed and the impugned communication is hereby set aside remanding the matter back to respondent No.2 - District Collector, Ranga Reddy, to consider the matter afresh. Thereupon, respondent No.2 shall take into consideration the order of dismissal dated 13.11.2019 passed by the trial Court in I.A.No.439 of 2019 in O.S.No.613 of 2019 as well as the judgment dated 02.01.2020 rendered by the Division Bench of this Court in CMA.No.1152 of 2019 and verify whether there is any other order passed by the Court with respect to the subject lands and pass appropriate orders. If any clarification is required from the petitioner, respondent No.2 shall intimate the petitioner to produce the relevant records therefor. This entire exercise shall be completed as expeditiously as possible, preferably, within a period of four (4) weeks from the date of receipt of a copy of this order.

Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
