THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M.S.K.JAISWAL W.P.NOS.3468, 3477 AND 3510 OF 2017 (Per Sri Justice Sanjay Kumar) C O M M O N O R D E R These writ petitions were filed assailing the notices of sale of immovable secured assets issued by the Indian Overseas Bank purportedly under Rules 8(5) and 9(1) of the Security Interest (Enforcement) Rules, 2002 on 19.01.2017.

While so, Sri M.V.K.Viswanadham, learned standing counsel for the Indian Overseas Bank, would inform this Court that what was subjected to challenge in these writ petitions were notices informing the petitioners of the intention of the bank to publish sale notice in newspapers. He would further submit that though the impugned notices mentioned the proposed dates of sale, no such sales were held and that the bank is yet to issue notices in accordance with Rules 8(6) and 9(1) of the Security Interest (Enforcement) Rules, 2002.

Recording the said statement, the writ petitions are closed leaving it open to the petitioners to seek redressal of their grievances, if any, as and when cause of action arises. All issues are left open. Pending miscellaneous petitions shall also stand closed. No order as to costs.
