THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.16820 OF 2013 ORDER:
In this writ petition, the petitioner seeks to declare the action of the official respondents in not appointing her as Anganwadi Worker to the B.C. Colony of Katepalli Village, Vinjamuru Mandal, SPSR Nellore District and accommodating the 5th respondent as such, as illegal and arbitrary.
The learned Government Pleader for Women Development & Child Welfare (A.P.), on written instructions, submits that the petitioner has got less marks than the 5th respondent in the interview conducted by the official respondents and accordingly, considering the merit, the 5th respondent was appointed as Anganwadi Worker.
As seen from the record, the reason for not considering the case of the petitioner for being appointed as Anganwadi Worker was not communicated to her and thereby she had no opportunity to challenge the same. In that view of the matter, the official respondents herein are directed to communicate the reasons to the petitioner for not being appointed as Anganwadi Worker along with a copy of appointment of 5th respondent. If the petitioner still feels aggrieved, she is at liberty to proceed in accordance with law. The writ petition is dismissed with the above observation. No costs.
