Kum V.Sindhura, Advocate representing Sri V.L.N.G.K.Murthy, learned counsel for the appellant informed that the sole appellant died, but did not disclose the date of death for different reasons and that she has no instructions .

The matter is listed under the caption "for dismissal" and on earlier occasion there was no representation on behalf of the appellant. In these circumstances, I am not inclined to grant time to obtain instructions. Hence, the appeal is dismissed for non prosecution, but without costs.
