Feeling aggrieved by the proposed action of respondent No.4 in laying road over the land forming part of the petitioner's premises, the latter has filed this writ petition.
On behalf of respondent No.4, its Secretary has filed a counter affidavit wherein he has inter alia stated that the Deputy Executive Engineer, Panchayat Raj Department, Sultanabad, Karimnagar District, issued a letter dt.23.04.2015 to the answering respondent stating that the work for strengthening the existing road is being carried out in Sultanabad Mandal from 23/5 Kms., (Suddala Rajiv Rahadari) to 189.50 Kms., (Chinnakalvala) under PMGSY-II funds, vide G.O.
Ms.
No.33, dt.15.02.2014, that the width of the road is 24 feet according to their standards and that accordingly respondent No.4 shall show the necessary width of the road at 8/751 Kms. That in pursuance of the above letter, the answering respondent cleared the existing road to the extent of 24 feet width by tractor blade to enable the Assistant Executive Engineer to undertake the work. He has further stated that the respondents are not laying any new road or widening the road by entering the petitioner's land in Sy. No.33, as alleged by him.
Mr. Suresh Kumar Potturi, learned counsel for the petitioners, submitted that in the light of the above noted averments made by the Secretary of respondent No.4 - Gram Panchayat, which reveal that there is no proposal to widen the existing road, his client's grievance stands redressed.
In the light of the above facts, the writ petition is disposed of as infructuous.
As a sequel to disposal of the writ petition, W.P.M.P. No.39066 of 2015 shall stand disposed of as infructuous.
