No.655 of 2017 JUDGMENT:- (Per Hon'ble Sri Justice Suresh Kumar Kait) The Miscellaneous Petition is filed seeking to condone the delay of 1374 days in filing the appeal.

A perusal of the docket sheet reveals that on the last occasion i.e. 04.10.2017, when the matter was taken up for hearing, none appeared for the petitioner / appellant. Same is the position today also. It is, therefore, reasonable to presume that the petitioner is not interested in prosecuting the matter any further.

Hence, A.S.M.P.No. 1610 of 2017 is dismissed for non-prosecution. Consequently, the appeal is rejected. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
