HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30400 of 2012 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself.

The present Writ Petition came to be filed to declare the action of the respondents in not taking any action on the representations dated 05.12.2011 and 11.08.2012 made by the petitioner with regard to the alleged encroachments made by the unofficial respondents in respect of the land admeasuring Ac.0.02 cents in Survey No.847 of Piduguralla Village and Mandal, which was assigned in her favour, as illegal and arbitrary. Though various grounds are raised in the Writ Petition, the learned counsel for the petitioner mainly submits that though DKT Patta No.100/1420F, dated 25.07.2011 was granted in favour of the petitioner by the fourth respondent, no action has been initiated by the respondents to clear the encroachments made in the said land. It is stated that though representations dated 05.12.2011 and 11.08.

2012 were made informing about the encroachments made, no steps are taken till date. Though no counter is filed, the learned Government Pleader for Revenue, on instructions, submits that when the Tahsildar concerned visited the site, he found no encroachments in the land which is a subject matter of dispute in the present Writ Petition.

Fact which remains undisputed is that the representations dated 05.12.2011 and 11.08.2012 made by the petitioner seeking protection from the encroachments in respect of the land assigned to her is still pending consideration.

Hence, without going into merits of the case and having regard to the said circumstances, the Writ Petition is disposed of directing the fourth

respondent to dispose of the representation dated 11.08.2012 made by the petitioner, in accordance with law, if the same is still pending, within a period of six (06) weeks from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
