HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10855 of 2004 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not permitting the petitioner to join duty from 05.06.2004 and not releasing and paying the salary for the period from 13.11.2003 to 17.12.2003 and from 25.01.2004 onwards, as illegal and arbitrary. A consequential direction is also sought to permit the petitioner to join duty forthwith treating him to be on duty from 05.06.2004 and to release and pay the salary of the petitioner for the period from 13.11.2003 to 17.12.2003 and from 25.01.2004 onwards.
When the matter is taken up for hearing, it is noticed that WPMP No.13797 of 2004 filed seeking to permit the petitioner to report to duty, is dismissed as infructuous, on the submission made by the counsel for the petitioner that the petitioner has already reported to duty, vide orders dated 12.06.2008. In view of the same, the cause in the main writ petition does not survive.
Accordingly, the writ petition is dismissed as infructuous. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 29th November, 2018 cbs
