THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition Nos.12849, 12850 and 12852 of 2009 COMMON ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) In all these three writ petitions, the action of the 2nd respondent, in directing the petitioner to appear before the Admission and Fee Regulatory Committee to select one of the two sets of question papers and in directing the petitioner not to conduct any more examinations as notified in the notification and to evaluate the answer sheets until further instructions from the committee, is questioned as being illegal and arbitrary.

By way of an interlocutory order dated 30.06.2009 the earlier Division Bench of this Court directed the respondents to permit the petitioner to conduct the Common Entrance Test for under-graduate courses on 04.07.2009 and for post-graduate courses from 06.07.2009 to 08.07.2009; the petitioner to comply with the Standards and Procedures for conduct of the Common Entrance Test by the consortium of associations of private un-aided professional educational institutions in Andhra Pradesh, published in A.P.Gazette, dated 19.07.2008 for the purpose of conducting entrance tests, for evaluation of answer sheets, for giving rankings, to follow the relevant rules, and to submit the requisite reports to the 2nd respondent; and also for the petitioner to publish the revised schedule in prominent newspapers in accordance with rules. Sriram, learned counsel appearing on behalf of the petitioner, submits that, pursuant to the said interim order, a Common Entrance Test was held; the students were admitted into these colleges, and they have completed their Engineering, M.B.A. and M.C.A courses; and the cause in the writ petitions no longer survives.

Recording the submission of the learned counsel appearing on behalf of the petitioner, all these three writ petitions are dismissed as infructuous. Miscellaneous petitions pending, if any, shall also stand dismissed.
