This Civil Revision Petition, under Section 115 of the Code of Civil Procedure, 1908, is filed by the revision petitioner/ Judgment Debtor No.4 seeking to direct the Executing Court to return E.P.No.214 of 2019 in A.R.C.No.411 of 2018 on the file of XXVII Additional Chief Judge, City Civil Court, Secunderabad.

Heard learned counsel for the revision petitioner/ Judgment Debtor No.4 and perused the record.

Learned counsel for the revision petitioner/ Judgment Debtor No.4 would submit that the Award, dated 20.06.2018, in A.R.C.No.411 of 2018 was passed by the Arbitral Tribunal without notice to the revision petitioner/ Judgment Debtor No.4 and ultimately, prayed to stay the proceedings in the subject E.P.

In the given circumstances, there is subsisting Award to be executed by the Executing Court. The revision petitioner/ Judgment Debtor No.4 has appropriate remedy, in the event of non-receipt of notice, as contended. It is for the revision petitioner/ Judgment Debtor No.4 to work out the remedies available to him under law. There are no merits in this Civil Revision Petition even to stay the proceedings in the subject E.P.

Accordingly, the Civil Revision Petition is dismissed. Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed. There shall be no order as to costs.
