HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 14505 of 2015 ORDER:

Heard learned Counsel for the petitioners and learned Counsel for the third respondent.

It appears that the third respondent filed claim No. 7 of 2010 before the second respondent under Section 61 of the A.P. Co-operative Societies Act seeking to pass an executable decree in its favour. When an enquiry was going on, the petitioners herein filed an application on 5.3.2011 seeking production of certain documents by the plaintiff in the claim No. 7 of 2010. It also appears that a counter claim was filed by the petitioners before the second respondent. When the application filed by the petitioners on 5.3.2011 was not disposed of, the present Writ Petition is filed.

This Court by order dated 14.5.2015 granted interim stay of all further proceedings in Claim No. 7 of 2010 on the file of the second respondent. Now, the third respondent herein filed WVMP.No. 1773 of 2015 seeking vacation of the said order. At this stage, the learned Counsel on either side agreed for disposal of the Writ Petition itself. The application of the petitioners dated 5.3.2011 for production of certain documents is pending consideration before the second respondent and the second respondent has

not passed any order on the said application since 2011. He did not proceed with enquiry also. In the circumstances, the second respondent is directed to consider the application filed by the petitioners on 5.3.2011 and pass appropriate orders in accordance with law within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
