THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20633 of 2016 ORDER :

The present Writ Petition came to be filed seeking to issue a writ of mandamus directing respondent No.4 to complete investigation in crime No.25 of 2015 of Kaikaluru Town police station, Krishna District.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents 1 to 4. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this court is not going into merits of the case, it may not be necessary to hear respondents 5 to 9.

3. Though various grounds are raised in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent No.4 to complete investigation in crime No.25 of 2015 of Kaikaluru Town police station, Krishna District and file final report expeditiously.

4. Grievance of the petitioner is that though the said crime was registered on 24.03.2015, till date there is no progress in the investigation. The same is disputed by

the learned Assistant Government Pleader stating that the aforesaid crime was registered for the offences punishable under Sections 420, 406, 506 read with 34 of the Indian Penal Code, 1860 and that the police are investigating the matter. It is stated that pursuant to an application made by the petitioner under the Right to Information Act, 2005, respondent No.4 furnished information on 13.05.2016 stating that the case is under investigation as some more witnesses have to be examined and documentary evidence i.e. records from the College Authority, have to be obtained. Therefore, it cannot be said that the respondents are not proceeding with the investigation.

5. Having regard to the circumstances of the case, respondent No.4 is directed proceed with the investigation in the aforesaid crime and file a final report, in accordance with law, as early as possible.

6. With the aforesaid direction, the Writ Petition is disposed of. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
