This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in S.C.No.31 of 2016 on the file of Special Judge for SC and ST Rajahmundry of Est Godavari District, registered against the petitioners/accused 1 to 5 for the alleged offences punishable under Section 323 read with 34 IPC and Section 31(x) of SCs and STs, (POT) Act, 1989. Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State.
A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, without insisting the presence of the petitioners 2 to 5 / accused 2 to 5, unless required for any specific purpose. The petitioner No.1/accused No.1 shall appear before the court below during the course of trial.
