Heard Mr.P.Narasimhulu for petitioners and the Assistant Government Pleader for Revenue.
The petitioners challenge notice dated 12.07.2012 primarily on the ground that without affording opportunity to petitioner conclusions on alleged encroachment have been recorded and further decided to remove the same in accordance with law. I have perused the notice dated 12.07.2012 and I am of the view that the notice impugned in the writ petition can be treated as show cause notice and petitioner be given opportunity to file explanation within time. Hence, the following order is passed: (a) the notice impugned in the writ petition shall be treated as show cause notice and the petitioner is given two weeks time from the date of receipt of a copy of this order to submit explanation to the notice along with a copy of this order;
(b) respondents 5 and 6 are directed to enquire into the show cause notice and take decision as is warranted in the facts and circumstances of the case;
(c) the said exercise shall be completed within two months from the date of receipt of explanation; and (d) the interim order is directed to be continued till a decision is taken and communicated to the party.
The writ petition is, accordingly, disposed of. There shall be no order as to costs.
Consequently, pending miscellaneous petitions, if any, stand closed.
