Heard learned counsel for the petitioners and learned Government Pleader of Home.

With the consent of both the parties, the writ petition is disposed of at the admission stage.

Since this Court is not considering the case on merits, it may not be necessary to issue notices to unofficial respondents. The action of respondent No.4 in not filing charge sheet in F.I.R.No.40 of 2016, dated 01.03.2016, is the subject matter of challenge in the present writ petition.

Learned counsel for the petitioners mainly submits that though the crime was registered in the month of March, 2016, till date no charge sheet is filed. On the other hand, learned Government Pleader opposed the same contending that having regard to the nature of allegations made, the matter requires thorough investigation and it may be difficult to file charge sheet within a period of three months as sought by the petitioners. Having regard to the nature of allegations made and taking into consideration the facts and circumstances of the case and the earlier order passed by this Court in Crl.P.No.5769 of 2016, respondent No.4 shall complete the investigation and file a final report, as early as possible.

With the above direction, the writ petition is disposed of.
