V.Nagaraju v. State Of Andhra Pradesh Rep By Principal Secretary,
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.18233 of 2016 ORDER:
The case of the petitioners is that they are landless poor persons and occupied lands in an extent of Ac.15.70 cents in Sy. No.15/2A of Gummalladoddi Village, Gokavaram Mandal, East Godavari District, (for short, 'the lands') and cultivating the lands for the last 50 years. The petitioners challenge the proceedings dated 28-05-2016 issued by the 2nd respondent in proposing to surrender the lands under Section 10 of the AP Land Reforms (Ceiling on Agricultural Holdings) Act, 1973 and in directing the persons in occupation of the lands to submit their objections with regard to their possession and enjoyment of the lands. The petitioners state that they are entitled for grant of pattas in the respect of the lands in their possession and in fact this Court in WP No.7652 of 1999, by order dated 12-04-1999 directed the 3rd respondent to consider their case for grant of pattadar pass books and pass orders within a time frame.
2. The grievance of the petitioners is that without considering their objections filed on 2-06-2016 to the impugned notice, the respondents are threatening to dispossess them from the lands. Hence, this writ petition.
3. Heard learned counsel for the petitioners and the learned Asst. Government Pleader for Revenue.
4. Inasmuch as the challenge in this writ petition is only against the notice dated 28-05-2016 issued by the 2nd respondent and the petitioners are stated to have already filed objections on 02-06-2016, the writ petitioner is disposed of directing the 2nd respondent not to dispossess the petitioners till the objections filed by them are considered and appropriate orders passed thereon in accordance with law.
5. With the above directions, the writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. ______________________________ A. RAJASHEKER REDDY, J Dated: 10-06-2016 NRG
