Kantheti Sai v. Padmanabhuni Satya Jyothi
HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No.3751 OF 2018 ORDER:
Questioning the order dated 25.06.2018 in I.A.No.284 of 2017 in O.S.No.92 of 2017 passed by the learned I Additional Junior Civil Judge, Tanuku, the petitioner/plaintiff filed the instant civil revision petition. Under the impugned order, the trial court dismissed the request of the petitioner to permit him to deposit the arrears of Rs.79,243/- into court on the main observation that whereas the petitioner/plaintiff filed the suit for injunction requesting the court to grant a decree directing the defendant not to disturb his possession, the respondent/defendant dispute the landlord-tenant relationship between the parties and therefore, the court cannot permit the petitioner/plaintiff to deposit the rent into the court.
2.
As can be seen from the impugned order, having regard to the factual scenario as is depicted from the pleadings, the trial court rightly rejected the request of the petitioner. Therefore, this Court finds no irregularity or perversity in the order impugned. 3.
Accordingly, this civil revision petition is dismissed at the admission stage. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ___________________________ U.DURGA PRASAD RAO, J 06.12.2018 SS
