ORDER:

This Writ Petition is filed for a Mandamus to declare the action of respondent No.1 in suspending the petitioner's temporary authorisation relating to Tiruchanoor Village, Tirupati Rural Mandal, Chittoor District, as illegal and arbitrary.

By order, dated 20.3.2009, this Court has granted interim suspension of the impugned proceeding. Learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh), on instructions, submitted that in pursuance of the above-mentioned interim order, the petitioner is being continued as the fair price shop dealer and that the proceedings initiated against him have not been concluded so far.

In the light of this submission of the learned Assistant Government Pleader, the Writ Petition is disposed of with the direction to respondent No.1 to complete the enquiry, pass a final order and communicate the same to the petitioner within two

months from the date of receipt of a copy of this order. Till this exercise is completed, the petitioner shall be continued as the fair price shop dealer.

Subject to the above direction, the Writ Petition is disposed of.
