THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.39922 OF 2016 ORDER :

Petitioner challenges the inaction on the part of the respondent-authorities in not taking a decision in determination of fee payable by the students seeking admission to law courses (3 years/5years) in private unaided colleges for the academic year 2016-17.

According to the petitioner, though he secured admission in MSSSL-Marwadi Siksha Samithi Law College, Hyderabad, he was asked to report before the college on 23.11.2016 with all the certificates. The amount of fee payable by the petitioner was not indicated in the said provisional allotment order and petitioner is not aware of what is the fee to be paid by him. 3.

Earlier learned counsel for the petitioner made fervent appeal to permit him to pay the tuition fee as applicable hitherto, and that was the relief sought by him in W.P.M.P.No.49186 of 2016.

Having regard to grievance expressed, learned Government Pleader, was directed to obtain instructions as to what is the stage of consideration of the proposal sent by the Telangana Admission and Fee Regulatory Committee.

Today learned Government Pleader produced letter No.235/UE/2014 dated 21.11.2016 addressed to the Consultant,

Telangana Admission and Fee Regulatory Committee. By this proceedings, the Government informed the Fee Regulatory Committee that it decided to follow the same fee structure as was prevailing earlier for the present academic year also. That means, the fee as earlier prescribed is now made applicable. This is what the petitioner wanted.

In view of the clarification now issued, petitioner is at liberty to appear before the concerned authority of the College, on 23.11.2016 in which he was provided admission by paying the fee as earlier determined i.e., Rs.9,600/- (Rupees Nine thousand six hundred only).

There is some merit in the concern expressed by the learned counsel for the petitioner that in view of the ambiguity in applicability of fee, lot of students may have been disturbed and were not sure in taking admission as there was no clarity on fee to be paid.

In view of the clarification now issued by the Government, the Principal Secretary to Government, Higher Education, may issue a statement through daily newspapers about the decision of the Government in observing the fee structure already determined for previous academic year. The Telangana Admission and Fee Regulatory Committee is also directed to give vide publicity through daily newspapers and also to upload the fee structure on the website of TSAFRC and Convenor, LAWCET and also intimate to all the Law Colleges.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
