THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14497 of 2015 ORDER:

Heard both sides.

This writ petition is filed seeking a Mandamus to declare the action of the 2nd respondent in not passing any orders on the application for stay filed along with the appeal, as illegal and arbitrary, and consequently, direct the 2nd respondent to dispose of the same expeditiously. In respect of the same proceedings, an appeal is pending before the Collector, Prakasam District. Therefore, the petitioner has to work out his remedies before the authority concerned and he cannot be permitted to prosecute two parallel proceedings for the same cause of action. Hence, the writ petition is dismissed. However, the Collector is directed to dispose of the application for stay, filed by the petitioner, as early as possible, preferably within a period of two (2) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, the miscellaneous applications, if any shall also stand disposed of.
