Sattu , Nampally Suvarna v. Sattu Sreenu , Srinivas
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO Tr.C.M.P.No.426 OF 2018 ORDER:
Heard both sides.
2.
This application is filed to transfer FCOP.No.72 of 2018, on the file of the Judge, Family Court, Secunderabad to the Court of the District Judge, Suryapet, Nalgonda.
3.
It is alleged in the affidavit filed in support of this application that the petitioner, who is the wife of the respondent, is residing at Suryapet, Nalgonda, and that it requires three hours travel to go from Suryapet to Secunderabad where the O.P. is filed and there is also a threat to petitioner's life from the respondent and his family members. It is also alleged that the mother of the petitioner is unwell and that her father is old and physically unfit to travel from Suryapet to Secunderabad repeatedly for each adjournment in the OP.
4.
Counter affidavit has been filed by the respondent opposing the transfer and pointing out that petitioner had lodged on 02.08.2016 an FIR before the Women's Police Station, CCS, Hyderabad, alleging that the respondent had committed offences punishable under Section 498-A of Indian Penal Code. Be that as it may, counsel for respondent did not seriously oppose the transfer of the FCOP.No.72 of 2018 from the Family Court, Secunderabad, to the Court of the District Judge, Suryapet. 5.
Therefore, the Tr.C.M.P. is allowed and FCOP.No.72 of 2018, on the file of the Judge, Family Court, Secunderabad, is
MSR,J TrCMP.No.426 of 2018 transferred to the Court of the District Judge, Suryapet. The said Court is directed to dispose of the said FCOP as expeditiously as possible and both parties undertake to co-operate with the said Court for quick disposal. No costs.
6.
Miscellaneous petitions, if any, pending in this Tr.C.M.P. shall stand closed.
