HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.22711 of 2018 ORDER:

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for respondents.

It is the case of the petitioner that he was issued notice under Section 91 of Cr.P.C dated 09.06.2018 to produce documents and respondent No.2 threatened the petitioner through telephone that he will be arrested. Aggrieved by the same, present Writ Petition is filed.

Learned counsel for the petitioner submits that the documents required to be produced are pertaining to the year 2008-2009 and it takes some time to produce the same before the police. He submits that the petitioner is not accused in any crime. On the other hand, learned Assistant Government Pleader for Home, on written instructions, submits that basing on the complaint given by one Adabala Narasimha Kondala Rayudu, they issued notice under Section 91 of Cr.P.C to produce the documents relating the property to an extent of Ac.8.11 cents in Relli Village, Kothavalasa. He submits that the petitioner received said notice on 29.06.2018, but he is not producing any document relating to the case. He further submits that the impugned notice was served on the petitioner as part of investigation only and petitioner was never threatened by the police.

In view of above facts and circumstances, this Writ Petition is disposed of permitting the petitioner to file the documents as required in the notice under Section 91 Cr.P.C dated 09.06.2018 within a period of four weeks from today, failing which, it is open for the 2nd respondent to take appropriate action in accordance with law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-07-2018 kvs
