HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.7572 OF 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in P.R.C.No.5 of 2017 on the file of the I Additional Judicial First Class Magistrate, Khammam.

A charge sheet came to be filed against the petitioner/A2 for the offences punishable under Sections 27(c), 27(b)(ii), 28 and 22(3) of the Drugs & Cosmetics Act, 1940. Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner/A-2 restricts his prayer seeking dispensation of the presence of the petitioner/A-2 before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioner/A-2 is not in dispute, his presence in the above P.R.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/A-2 in P.R.C.No.5 of 2017 on the file of the I Additional Judicial First Class Magistrate, Khammam, is hereby dispensed with except

on the dates when his presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous applications, if any, pending shall stand closed.
