THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9364 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.135 of 2023 on the file of Kadthal Police Station, Cyberabad, registered for the offences under Sections 3 and 4 of the Explosives Substances Act, 1908 and Sections 337, 336 and 427 r/w. 34 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner who is a contractor was arrested on the ground that he secured explosive substances for blasting work at a drainage canal. After completion of work, the gelatin sticks and detonators were left near the drainage canal negligently which endangered the human lives. When the garbage was set on fire, the explosives left back by this petitioner and another accused resulted in explosion.

Keeping in view that even according to the investigation, this petitioner was a contractor of the work and secured explosive substances for the purpose of executing work, the petitioner can be granted the relief of regular bail, subject to following conditions: i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of Additional First Class Magistrate at Amangal.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
