THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.22685 OF 2018 ORDER:

This writ petition is filed challenging the action of the respondents in selecting the unofficial respondents as Veterinary Assistants in Agency Area, contending that the unofficial respondents do not belong to local schedule area and are ineligible to be appointed as Veterinary Assistants in Agency Area.

Learned counsel for the petitioners submits that the unofficial respondents have fraudulently obtained local S.T certificates from the authorities and, based upon such certificates, the official respondents are appointing the unofficial respondents. Learned counsel further submits that vide orders dated 05.07.2018, this Court granted interim direction to the 1st respondent not to make any appointment to the post of Veterinary Assistants in Schedule Area.

Learned counsel appearing for the unofficial respondents had submitted that the unofficial respondents are local Scheduled Tribe candidates and that, after verifying their cases individually, the official respondents have issued the local S.T certificates in favour of the unofficial respondents and the allegations leveled by the petitioners are totally false and incorrect.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the 2nd respondent to re-verify the certificates of all the selected candidates within a period of two weeks and, after conducting such verification, the authorities are at liberty to give

appointment orders. It is needless to say that the appointment orders be given to the persons whose certificates are genuine. With these observations, the writ petition is disposed of. No costs.
