THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.22594 of 2018 ORDER:
On 03.07.2018 and 09.07.2018, at request, time was granted to respondents to place before the Court, the written instructions.
The Assistant Government Pleader places on record, the written instructions dated 12.04.2018.
The operative portion reads thus:
"I submit that as per the Revenue Records, the writ petitioners possess land in R.S.No.90/2C Ac.0.8167 cts and R.S.No.90/2B Ac.0.8167 cts in Bhimadole village, Bhimadole Mandal. The said land is in possession and enjoyment of the writ petitioners. While the matter stood, an alienation propsal was made in favour of the SubTreasury Office, Bhimadole for Ac.0.06 cts and Mini Rythu Bazar for Ac.0.10 cts in R.S.No.78/1A which is classified as Grama Kantam. The proposed land is on western side of the petitioners land. The alienation land is duly surveyed by the Mandal Surveyor, Bhimadole and was earmarked with boundaries. During the survey, it was noticed that the said writ petitioners are in encroachment of the Grama Kantam i.e., in R.S.No.78/1A which is western boundary to the writ petitioners land. The writ petitioners have voluntarily evicted from the said land i.e., in R.S.No.90/2B, 90/2C as alleged by the writ petitioners."
Learned counsel for petitioner prays to place the stand of respondents on record and dispose of the writ petition.
Hence, the writ petition is disposed of accordingly. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
