HONOURABLE JUSTICE G. SRI DEVI Writ Petition No.25883 of 2019 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, seeking to quash the proceedings in Cr.No.212 of 2019 on the file of Banjara Hills Police Station, Hyderabad, registered for the offences under Section 506 IPC and under Section 3(1)(r)(s) of SCs & STs (POA) Act, 2015, against the petitioners/accused. 2.

During hearing, learned counsel for the petitioners and learned Government Pleader for Home, appearing for respondents, submit that the notice under Section 41-A Cr.P.C., has already been issued to the petitioners.

Since the 1st respondent-police issued a notice under Section 41-A Cr.P.C., to the petitioners, it would be appropriate to direct the petitioners to comply with the said notice as per the directions of the Apex Court in Arnesh Kumar v. State of Bihar and another1. However, no coercive steps shall be taken against the petitioners till filing of the final report. 4.
