HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1224 of 2015 O R D E R:
1. The present revision is preferred against the order dated 13.8.2014 passed by the Special Judicial First Class Magistrate for Excise Cases at Hyderabad in Crl.M.P.No.1033 of 2014 in Crime No.513 of 2014 of Jubilee Hills Police Station.
2. The 2nd respondent herein, who was rescued from the brothel house, where she was subjected to sexual work, is the wife of the petitioner. The petitioner filed the above Crl.M.P. for her custody. The said application was dismissed under the order impugned. While dismissing the above Crl.M.P. the learned Magistrate directed to place the 2nd respondent in the intermediate care, custody and protection of PRAJWALA protective home recognized under Section 21 of the Act for a period of two years from the date of initial admission i.e., 4.6.2014. Aggrieved by the same, the petitioner filed this revision.
3. Heard and perused the material available on record.
4. The order under revision was passed in view of the fact that the 2nd respondent was rescued from the brothel house, where she was subjected to sexual work. Now the 2nd respondent is in the custody of PRAJWALA protective home. It is stated that she has been in the custody of the said protective home for 14 months.
5. On 18.6.2015, when this matter had come up, this Court directed the Public Prosecutor to obtain the opinion of the 2nd respondent as to whether she is ready to join the petitioner herein, who claims to be her husband.
6. Today, the learned Public Prosecutor submitted that the investigating officer recorded the statement of the 2nd respondent and
she intends to join the petitioner, who is her husband. Further, it is also brought to the notice of this Court that the son of the petitioner and the 2nd respondent expired recently.
7. Considering the above facts and circumstances of the case, the Criminal Revision Case is disposed of with the following directions: (i) The two years period ordered by the Court below for custody and protection of the 2nd respondent under Prajwala protective home is reduced to the period, which she has already spent. (ii) The authorities of the above Protective Home are also directed to hand over the 2nd respondent to the petitioner herein immediately."
8. With the above direction, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
