HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 15856 of 2016 ORDER:

Appeared none on behalf of the petitioner on the last occasion on 15.11.2016. Same is the position today also. Vide present Criminal Petition, the petitioner/Accused No.2 seeks anticipatory bail in the event of his arrest in connection with Crime vide PCOR No.583 of 2015016 pending adjudication on the file of learned Judicial First Class Magistrate, Narayanpet, registered for the offence punishable under Section 8 (c) read with 22 of NDPS Act. On 18.10.2015 the Investigating Agency ride the house of Accused No.1 and found 15 Kgs of Alprazolam. On the confessional statement of Accused No.1, Accused No.2 was arrested. From the confessional statement of A.1, it is clear that A.2 was residing in the same house where contraband was recovered.

The police have to investigate the case and therefore the custodial arrest of Accused No.2 is required. Considering the material available on record, I am not inclined to enlarge the petitioner on bail.

The Criminal Petition is dismissed. Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence.
