THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 3929 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "That this Hon'ble Court may be pleased to issue appropriate writ, orders or directions, preferably in the nature of writ of Mandamus, declaring the action of the 4th respondent in seizing the documents i.e., document No.3299 of 2015 of Kanchikacherla Village and Mandal of Krishna District of the petitioner is illegal, arbitrary and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case and in the interest of justice, otherwise we shall be put to grave hard ship."
2. The Sub-Inspector of Police, II Town Police Station, Vijayawada City, furnished written instructions dated 16.02.2016 to the office of the learned Government Pleader for Home wherein he stated that upon the complaint made by one Allu Suresh, Crime No.480 of 2015 was registered under Sections 474, 420, 384 and 506 IPC r/w Section 34 IPC on the file of II Town Police Station, Vijayawada City. In the course of investigation the police authorities were stated to have seized the document bearing No.3299 of 2015 and produced the same along with the other seized documents viz., promissory notes and blank cheques before the learned Chief Metropolitan Magistrate, Vijayawada, vide C.F.No. 1496 of 2016.
3. In the light of the afore-stated developments, the Writ Petition is closed leaving it open to the petitioner to take recourse to appropriate remedies in accordance with law.
