HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 15925 of 2016 Order:

The petitioner is working as School Assistant in Government High School, Mossamali, Warangal District. The Government issued orders in G.O.Rt.No.1214, dated 12.08.1997, directing the District Educational Officers to re-deploy one School Assistant working in the Government School to the post of District Co-ordinator in Open School Society. The petitioner claims that he possessed requisite qualification and eligible for being appointed as District Co-ordinator, but the respondents have appointed one Shanker Rao who was working as School Assistant in Mandal Parishad Upper Primary School, Karakapalli village, Ghanpur, Mulug, Warangal District, in the place of one V. Suresh who is working in the Government School. Challenging the same, the said Suresh filed OA Nos.

6407 of 2014, 7385 of 2014 and 1404 of 2015 and the same were dismissed by a common order. Pursuant to the observation made by the Administrative Tribunal, the fourth respondent enquired into the matter and noticed that Shanker Rao was working as School Assistant under the control of Zillal Parishad Management and accordingly addressed a letter dated 18.09.2015 requesting the second respondent to pass appropriate orders in view of the observations made by the Administrative Tribunal. The second respondent in turn addressed a letter dated 31.03.2016 requesting the fourth respondent to obtain legal opinion in the matter. When no action was taken, the petitioner submitted an application on 17.03.2016 with a request to re-deploy him and appoint as District Co-ordinator.

When no action was taken, the present Writ Petition is filed seeking consideration of the representation dated 17.03.2016.

2. In spite of granting three adjournments and issuing notice before admission, no instructions were received by the learned Government Pleader.

3. In the circumstances, the Writ Petition is disposed of directing the respondents 3 and 4 to consider the representation of the petitioner dated 17.03.2016 and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
