THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.5371 of 2016 ORDER:

The criminal petition is filed against the order dated 03.03.2016 in Criminal Revision Petition No.68 of 2014 on the file of the IX Additional Sessions Judge, West Godavari at Kovvur, by and under which, the Court below confirmed the order of the trial court in awarding maintenance to the 1st respondent @Rs.2,000/- per month.

Heard the petitioner-in-person.

The petitioner is the husband and the 1st respondent is the wife. The petitioner is a retired employee and is getting pension more than Rs.20,000/- per month. On the maintenance petition filed by the 1st respondent/wife, the trial Court, having considered the oral and documentary evidence and considering the facts and circumstances of the case and income sources of both parties, awarded maintenance to the wife @Rs.2,000/- per month. Aggrieved by the said order, the petitioner/husband preferred appeal, where he became unsuccessful, hence the present petition. The main contention of the petitioner/husband is that the 1st respondent is not his legally wedded wife and she never lived with him as wife and hence she cannot be entitled to seek maintenance from him, and further, the award of maintenance granted by the trial Court is excessive.

I have perused the entire material available on record. I see no reason to interfere with the findings of the Courts below. The maintenance awarded by the trial Court

@Rs.2,000/- per month is very meager considering the present day cost of living. There are no merits in the present petition and the same is liable to be dismissed. The Criminal Petition is accordingly dismissed. Pending miscellaneous applications, if any, shall stand closed in consequence.
