HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Having regard to the order passed by the Tahsildar in Memo dated 19.08.2019, learned counsel for petitioner fairly submits that though initial claim was Ac.1.00 guntas and proceedings were issued on 21.06.2016 granting mutation in the name of petitioner to that extent in Sy.No.337 of Nizamabad Shivar, Nizamabad district, for the present petitioner is satisfied if mutation proceedings are completed and pattadar pass books are issued on land to an extent of Ac.0.34 guntas in Sy.No.337 of said village, and seeks leave to work out his remedies to the remaining extent of land. Said liberty is granted. 2.

From the reading of the Memo dated 19.08.2019, it appears though earlier proceedings were issued for Ac.1.00 guntas, but on conducting field inspection and demarcation of the land in possession of the petitioner, it was found that petitioner is in possession only to an extent of Ac.0.34 guntas and, therefore, the Tahsildar directed the Village Revenue Officer to implement the orders of Tahsildar, dated 21.06.2016 to the extent of Ac.0.34 guntas only.

Unless the order of Tahsildar is assailed by any person claiming interest in the said property or the proceedings are withdrawn by the Tahsildar, the Village Revenue Officer (5th respondent) is directed to comply the orders issued by the Tahsildar dated 19.08.2019 regarding mutation exercise and issuance of pattadar pass book to the petitioner to an extent of Ac.0.34 guntas in Sy.No.337 of Nizamabad Shivar, within a period of four weeks from the date of receipt of copy of this order. 4.

Writ Petition is accordingly disposed of. Pending miscellaneous petitions shall stand closed.
