THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.15476 of 2014 ORDER:

This writ petition is filed for the following relief: "to issue any writ, order or direction, one more particularly in the nature of a Writ of Mandamus to declare the action of the 3rd respondent in calling the petitioner and his old aged mother to the police station at the behest of the 4th respondent without there being any sort of complaint or case registered against them as being illegal, arbitrary and unconstitutional and consequently direct the 2nd respondent herein to take appropriate action against the 3rd respondent for misusing his official power and for indulging in illegal acts, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

Learned counsel for the petitioner is not present and there is no representation on her behalf.

Learned Government Pleader for Home is present and denied the allegations made in the petition. She produced a xerox copy of the complaint of the petitioner, and on its reverse side, a compromise memo entered into between the petitioner-wife and respondent-husband with regard to their disputes and submitted that the parties have compromised before elders and therefore, the petitioner-wife requested not to take any action against the respondent-husband.

Learned Government Pleader for Home, based on the written instructions, submits that the 4th respondent lodged a complaint on 28.05.2014 stating that her husband and his family members are harassing her for additional dowry and requested the police to conduct counselling. The Station House Officer, basing on the said complaint, called both the parties for counselling. But the petitioner did not approach the counselling authorities and therefore, no action was taken against the complaint.

On consideration of the facts and circumstances of the case and also in view of the compromise memo produced by the learned Government Pleader for Home, it appears that the petitioner had compromised the matter, as such there is no representation on behalf of the petitioner and she is no longer interested to prosecute this writ petition.

Hence, this Writ Petition is closed. No costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
