Learned counsel for the appellant stated that the suit for injunction was dismissed by the trial Court and appeal was allowed. Against which the Second Appeal IS preferred. As the relief of injunction is obtained in personam but not in rem. It is informed to this Court that plaintiff in O.S. No.9O of 1990 on the frle of District MunSiff at Shadnagar is no more.

Recording the said submission, the Second Appeal is accordingly dismissed. No order as to costs.
