HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 17246 of 2002 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the promotion of the respondents 4 and 5 vide proceedings dated 22.07.2002, as illegal and arbitrary. A consequential direction to the respondents is also sought to consider the case of the petitioner for promotion to the post of adhoc principal according to his seniority. Heard learned counsel for the petitioner and learned Government Pleader for Social Welfare appearing on behalf of the official respondents.
Admittedly, the administration can make in-charge arrangements and effect promotions on adhoc/temporary basis and the seniority and other rights would not accrue in respect of temporary promotions. Since the challenge is to adhoc/temporary promotions, no rights of the petitioner have been affected by effecting the promotions on temporary basis. I find no merits in the writ petition. Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
