HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No. 5792 OF 2017 ORDER :

Heard the learned counsel for the petitioner/A.1 in Cr.No.123 of 2010, dt.27.10.2010 on the file of the Ongole II town Police Station, Prakasam District registered for the offence punishable under Sections 409 and 477 r/w 34 IPC, dated 27.10.2010 which is nearly 7 years old crime but still no final report shown filed and also the learned Public Prosecutor for the 1st respondent-State and perused the grounds urged in the quash petition.

This Court to subserve the ends of justice, chooses to direct the Investigating Officer to complete investigation and file final report within two months from the date of receipt of the order without arrest of the petitioner since the crime is pending for nearly 7 years. However, remedies of the petitioner are left open. The contention regarding the sanction required is also left open.

Accordingly and in the result, the Criminal Petition is disposed of. Consequently, the pending miscellaneous petitions in this Criminal Petition shall stand closed.
