HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 15261 of 2005 ORDER:

When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation during pendency of the writ petition and he is challenging the orders dated 04.10.2004 passed by the 1st respondent-Labour Court in I.D.No.110 of 2003 wherein no relief was granted to him. The petitioner was challenging the orders of removal before the Labour Court. He sought a direction in this writ petition to set aside the orders of removal and reinstate him into service. The relief sought by him at this point of time cannot be feasible as he has attained the age of superannuation. However, this Court is of the considered view that the writ petition can be disposed of directing the respondent corporation to pay the service benefits of the petitioner for the service rendered by him prior to his removal from service, if not already paid, in accordance with the Regulations, within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 28th December, 2018 cbs
